Landmark ruling to personal/carer’s leave overturned by High Court

August 17, 2020

A majority High Court has upheld the appeal and overturned the ruling handed down by the Full Federal Court in August 2019. This now means that employers can revert to the historic way of calculating personal/carer’s leave: full-time employees are entitled to 10 days per annum and part-time employees receive a pro-rated amount based on their ordinary hours of work.

Domestic and family violence can affect anyone, and the workplace is often a critical place for support. As employers and HR professionals, it is important to have policies, support systems, and a culture that allows people to feel safe and supported. 

What are some simple yet practical steps for workplaces to consider?
✔️ Ensure your policies include provisions for leave, flexible work arrangements, and safety measure. Make sure employees are clear on their rights and options. This can help reduce absenteeism and builds trust that encourages employee retention.
✔️ Train and equip managers to recognise warning signs, respond sensitively, and maintain confidentiality. Early support prevents escalation, protects team morale, and strengthens the capability of your leaders. 
✔️Promote access to Employee Assistance Programs (EAP), counselling, and community resources. This can be effective in improving wellbeing, productivity, and reducing stress-related burnout.
✔️ Encourage a culture of open, non-judgmental conversations and ensure employees feel safe to speak up. This fosters engagement, loyalty, and psychological safety. Overall employees perform better when they feel valued and protected.

A proactive approach doesn’t just comply with obligations.

🔥 Preventing Burnout Before EOFY As EOFY approache 🔥 Preventing Burnout Before EOFY
As EOFY approaches, deadlines tighten, budgets close out, and performance conversations ramp up. Stress is predictable — burnout doesn’t have to be.

Here’s what smart employers are doing now:

✔️ Review workloads – Has short-term coverage, backfill arrangements, or project-based work gradually become part of someone’s permanent role without a formal review? Temporary stretch can build capability however ongoing overload can erode performance.
✔️ Encourage leave planning – High pressure combined with large annual leave balances can be a red flag. Are there employees with low personal/sick leave remaining but significant annual leave accrued? Encouraging a proper break now may help protect their health, reset stress levels, and reduce the risk of burnout heading into EOFY. Planned rest is far more effective than unplanned absence.
✔️ Set realistic deadlines – Not every task is urgent, even at EOFY. Consistent “all hands-on deck” pressure isn’t a strategy; it’s a fast track to fatigue. Sustainable pacing protects performance, quality, and retention long term.
✔️ Check in with managers – They’re often the buffer between organisational pressure and team wellbeing. Managers carry targets, performance conversations, and the emotional load of their teams. Supporting them early helps prevent stress from cascading through the business.
✔️ Reward effort, not just output – Recognition protects morale – Acknowledging dedication and persistence helps maintain morale, even when outcomes aren’t perfect. Remember: burnout isn’t only a wellbeing concern — it affects productivity, staff retention, and increases organisational risk. Celebrating effort keeps your team motivated and resilient.

Why address this now?
It’s early in the year when motivation can dip after Q1 pressure. A proactive 30-minute leadership check-in now can prevent months of disengagement later.
