In recent months, there has been substantial atten

In recent months, there has been substantial attention and conversation surrounding legislation concerning employees' rights to disconnect from work.

On February 12, 2024, Parliament passed the Fair Work Legislation Amendment (Closing Loopholes No. 2) Bill 2023. One significant change brought about is the establishment of a legally enforceable right for employees to "disconnect" and decline communication from their employer beyond their regular working hours, without fear of reprisal.

This means employees will have a legal right under the Fair Work Act to refuse to monitor, read, or respond to contact or attempted contact from their employer outside of working hours unless the refusal is unreasonable.

The employer’s reasons for contact are merely one of several factors that will be considered in that refusal, alongside the employee’s role or level of responsibility and payment to work extra hours to remain available.

The right to disconnect provisions will take effect in August 2024 (Feb 2025 for small businesses).
