Landmark ruling to personal/carer's leave overturned by High Court

ourhrteam

The Federal Government recently introduced a bill The Federal Government recently introduced a bill to create a ‘universal’ entitlement to 10 days paid family and domestic violence leave (FDVL) into the National Employment Standards (NES)

The proposed entitlement if passed will replace the current NES entitlement of five days unpaid FDVL which is currently endorsed by the Fair Work commission.

The key proposed changes are:
•	Extension of the current definition of FDV to include “a member of a person’s household and a current or former intimate partner”
•	Increase from 5 days unpaid leave to 10 days paid leave
•	Leave will be available upfront, not accrue
•	Leave will be available paid to all employees – permanent and casual who have been ‘rostered’ (have accepted an offer to work)
•	Leave will be paid at the rate of “what would have been earnt” not base rate (including loadings, allowances and potentially commissions and incentives).

The new form of paid leave will apply to all national system and non-national system employees, including employees under enterprise agreements which already have paid FDVL entitlements.

Stay tuned for further updates as the bill progresses.

📢Award Rate Changes - July 2022 National Minim 📢Award Rate Changes - July 2022

National Minimum Wage has increased by $40 per week (5.2%) this year. This has elevated the national minimum wage to $812.60 per week, or $21.38 per hour for Permanent staff and $26.73 for Casuals.

Award minimum wages have increased by 4.6%, which is subject to a minimum increase for award classifications of $40 per week and based on a 38-hour week for a full-time employee. This means minimum award wages above $869.60 per week, will get a 4.6% increase, and below $869.60 per week, will get a $40 increase.

Increases apply from the first full pay period on or after 1 July 2022. This means if you have a weekly pay period that starts on Mondays, the new rates will apply from Monday 4 July 2022. The exception to this is Aviation, Hospitality and tourism industries which will increase on 01 October 2022.

📢 Super Increase - 01 July 2022.

In addition to an increase in minimum wages, there are changes to superannuation (super) which take effect from 1 July and includes the:

- increase in the super guarantee rate from 10% to 10.5%
- removal of the $450 super guarantee threshold

The change is effective from the first pay in July., so if you pay weekly that means you pay 10.5% super on the entire week commencing 27 June.
